General terms and Conditions of Participation (Version: 10.08.2017) 

Stemme AG ("the Organizer “) 

The following conditions shall apply to contracts between the Organizer (Stemme AG) and the respective contractual partner. They apply exclusively. Conditions deviating from these terms and conditions do not apply.  

 

1. REGISTRATION

Early registration is recommended. The participation/exhibitor fee is due at the latest at the commencement of the event, but not prior to receipt of the invoice. 

 

2. LIABILITY

The Organizer shall be liable in the course of performance of its contractual obligations only for its own intentional or grossly negligent breaches of duty or those of its lawful representatives or vicarious agents. In the event of the breach of a material contractual obligation there is full liability, in the case of simple negligence however liability is limited to the reasonably foreseeable damage typical for this type of contract. The liability of the Organizer or its lawful representatives or vicarious agents for damage arising from culpable injury to life, limb or health and for compliance with any guarantees is not affected.

 

3. CANCELLATION

The Organizer plans its resources according to registrations. In booking speakers, event facilities, catering etc, the Organizer has to make commitments in order to be able to achieve an event of good quality at reasonable prices. Accordingly registration for an event must be regarded as confirmed. Should there be a cancellation notwithstanding, the following cancellation terms shall apply: If you have to cancel, you can do this simply and at no cost up to 15 days before the event. Cancellation must be in writing. In the case of cancellation within 14 days prior to commencement of the event, we charge a fee for expenses incurred of 35% of the standard participation fee. 

The day of the event shall not be included in the calculation of the period. In the case of cancellations on the day of commencement of the event or non-attendance without prior notice of cancellation we shall invoice you for the full event fee. A substitute participant from the same undertaking can be nominated at no charge. 

The contractual partner retains the right to prove smaller damages on the part of the Organizer.

 

4. ALTERATIONS TO THE PROGRAM


The Organizer reserves the right to make changes to the program in exceptional cases. If by reason of unforeseen circumstances the event has to be cancelled, notice will be given immediately. In this event the Organizer shall be obliged only to reimburse any fees already paid. If by reason of unforeseeable circumstance the event has to be postponed, notice will be given immediately. n this case the participant may cancel within 7 days in writing at no charge. If no cancellation occurs, the new date shall be deemed to have been accepted. Additionally para.2 shall apply. 

 

5. IMAGE AND SOUND RECORDINGS

In all cases the making of image and sound recordings in the course of an event requires the prior written agreement of the Organizer. The same shall apply for each subsequent use of image and sound recordings of the event. The contractual parties agree to the use without charge of image and sound recordings of their person created in the course of recordings made by the Organizer. 

 

6. EVENT PAPERS/DOCUMENTATION

Any transfer of use of event documentation and training documents to third parties whether fee-paid or free of charge requires the prior written agreement of the Organizer. 

 

7. DATA PROTECTION NOTICE


The collection, processing and use of personal data of the contractual partner shall be carried out in strict compliance with the German Federal Data Protection Act (Bundesdatenschutzgesetz). The use and processing f the data shall be carried out exclusively for performance and invoicing purposes and to send the contractual partner information concerning Stemme AG by post or email. 

The contractual partner may at any time object to the processing and use of data for the purposes of transmitting information.

8. SEVERABILITY CLAUSE 

Should individual provisions of these conditions be or become wholly or partially invalid, the validity of the remaining provisions of the contract shall not be affected. 

 

9. JURISDICTION/CHOICE OF LAW

Place of jurisdiction for all disputes arising from the contract between the Organizer and the contractual partner is Frankfurt Oder, Germany.
